Emirates is Dubai's flag carrier, founded in 1985 and now one of the largest long-haul airlines in the world. It operates more than 260 aircraft, including the world's biggest fleets of Airbus A380s and Boeing 777s, carrying around 58 million passengers a year to over 140 destinations in more than 80 countries from Dubai International Airport. Emirates belongs to no alliance, but partners closely with flydubai across a combined network of some 240 destinations.

Emirates is registered in the United Arab Emirates, which makes it a non-European carrier under EC 261/2004. Your rights depend on where the flight departed from rather than on the airline's nationality: every Emirates flight leaving a European airport is fully covered, while flights arriving in Europe from Dubai are not.

Emirates carries an unusually large share of Europe's long-haul premium traffic, and that creates a second entitlement most passengers never claim. Alongside delay compensation, EC 261 gives you a substantial refund if you are downgraded — and on Emirates fares, that figure can dwarf the €600.

This guide explains which flights qualify, how much Emirates compensation you can claim, how an Emirates refund works under EC 261, and how FlyPayout handles your claim.

Why Emirates' registration matters for your rights

Emirates is headquartered in Dubai and holds a UAE air operator's certificate. It is not a European carrier, so EC 261 applies on departure point alone.

Departures from Europe are fully covered. A flight from London, Manchester, Glasgow, Dublin, Paris, Frankfurt, Munich, Düsseldorf, Amsterdam, Zurich, Vienna, Milan, Rome, Madrid, Athens, Larnaca, Malta, Prague or Copenhagen to Dubai falls under EC 261 in full, exactly as if a European airline were operating it.

Arrivals into Europe from Dubai are not covered. A Dubai to Frankfurt or Dubai to London flight sits outside the regulation, because neither the departure point nor the carrier is European.

That boundary is firmer here than on most non-European airlines. Carriers inside Star Alliance, oneworld or SkyTeam often have European partners operating their codeshares, which can pull an inbound leg into scope. Emirates is independent, and its main operating partner flydubai is also UAE-registered. On this network the outbound leg is where your entitlement sits.

How much Emirates flight compensation can you claim?

Under EC 261, compensation is fixed by distance:

Flight distance

Compensation

Up to 1,500 km

€250

1,500 km to 3,500 km

€400

Over 3,500 km

€600

Almost every Emirates route from Europe crosses 3,500 km. Only the eastern Mediterranean sits below it.

Route (departing Europe)

Approximate distance

Compensation

Larnaca to Dubai

~2,340 km

€400

Athens to Dubai

~3,275 km

€400

Malta to Dubai

~4,050 km

€600

Vienna to Dubai

~4,225 km

€600

Rome to Dubai

~4,345 km

€600

Frankfurt to Dubai

~4,845 km

€600

London Heathrow to Dubai

~5,495 km

€600

Madrid to Dubai

~5,650 km

€600

Glasgow to Dubai

~5,840 km

€600

Dublin to Dubai

~5,920 km

€600

These amounts are per passenger. A family of four on a disrupted London to Dubai flight can claim €2,400 in total, and the figure has nothing to do with what the tickets cost.

Downgrading: the claim Emirates passengers miss

If Emirates places you in a lower class than the one you booked, EC 261 requires reimbursement of part of the ticket price. This is a separate entitlement from delay compensation, set by Article 10.

Flight distance

Reimbursement of ticket price

Up to 1,500 km

30%

1,500 km to 3,500 km

50%

Over 3,500 km

75%

On a Europe to Dubai route, that is 75%. On premium fares, the numbers become significant: a downgraded First Class passenger who paid €5,000 is looking at €3,750, several times the maximum delay compensation.

Downgrades happen here more often than on most networks, for a structural reason. Emirates operates several A380 configurations, including a 615-seat version without First Class, and substitutes Boeing 777s onto A380 routes when aircraft are unavailable. Every such swap moves premium passengers down a cabin.

The entitlement applies whenever the downgrade is involuntary, and is owed regardless of why the aircraft was changed. Extraordinary circumstances are a defence against delay compensation, not against Article 10 reimbursement.

When do you qualify for Emirates delay compensation?

Flight delays

If your Emirates flight departed a European airport and arrived at its final destination 3 or more hours late, you qualify for Emirates flight delay compensation. The delay is measured on arrival, not departure, so a flight that pushes back late but recovers time in the air may not qualify. It must also not have been caused by extraordinary circumstances beyond the airline's control.

Cancelled flights

If Emirates cancelled your Europe-departing flight and notified you less than 14 days before departure, you are entitled to Emirates flight cancellation compensation at the same amounts, plus a choice between a full refund and rebooking. Notice of 14 days or more removes the entitlement but not the refund or rebooking right.

Denied boarding

If Emirates involuntarily denies you boarding on a Europe-departing flight because it is oversold, compensation is payable immediately at the airport. The airline must seek volunteers first.

Missed connections through Dubai

Emirates is built around Dubai as a super-connector, and most European passengers transit rather than ending their journey there, with onward flows to Australia, South and Southeast Asia and East Africa.

If a delay leaving Europe caused you to miss that connection and the journey was on a single booking, compensation is calculated on the total journey distance and your arrival delay at the final destination. A London to Dubai to Sydney itinerary disrupted on the first leg is assessed on London to Sydney.

Emirates and flydubai: check who operated the flight

Emirates and flydubai have run a joint network since 2017, offering around 295 codeshare flights a day and giving Emirates passengers access to more than 130 flydubai destinations. Many itineraries sold under an EK code are flown by flydubai under an FZ code.

Both are UAE-registered, so your rights are identical either way. But the claim must name the carrier that actually operated the flight, and one filed against the wrong entity is rejected on a technicality without ever being assessed. FlyPayout identifies the operating carrier from the flight number and files accordingly.

Emirates refund policy under EC 261

When your Europe-departing Emirates flight is cancelled, or delayed by 5 or more hours, EC 261 requires a full refund within 7 days, covering taxes and fees on any unused portion, plus a return flight to your departure point if you have already flown part of the trip. The alternative is rebooking on the next available flight or at a later date.

An Emirates refund on these grounds overrides the fare conditions entirely. A Special or Saver fare sold with heavy change restrictions is fully refundable when the airline is the party cancelling.

What Emirates must provide during disruptions

Whether or not compensation is owed, Emirates must provide care when a Europe-departing flight is delayed:

Delay threshold

What you're entitled to

2+ hours (flights up to 1,500 km)

Meals, refreshments, 2 phone calls or emails

3+ hours (flights 1,500 km to 3,500 km)

Meals, refreshments, 2 phone calls or emails

4+ hours (flights over 3,500 km)

Meals, refreshments, 2 phone calls or emails

Overnight delay

Hotel accommodation plus transport to and from the hotel

5+ hours

Right to abandon the journey plus full refund

Care is owed regardless of the cause, including where the disruption was an extraordinary circumstance. If nothing is offered, cover the costs yourself, keep receipts and claim reimbursement.

Emirates and extraordinary circumstances

Emirates is not required to pay compensation when a disruption is caused by events genuinely outside its control: severe weather, air traffic control restrictions or strikes, security threats, and airspace or airport closures ordered by authorities.

These do not qualify: technical faults, maintenance issues, crew shortages or illness, and strikes by the airline's own staff.

Airspace disruption versus fleet programmes

Regional airspace disruption affected Middle East operations through 2025 and 2026, and Emirates reduced capacity in response. Where a specific closure genuinely prevented a flight, that is an extraordinary circumstance.

But part of the same period's schedule changes has been attributed to Emirates' own A380 reconfiguration programme, running alongside the geopolitical factors. A cabin retrofit is a commercial decision planned years in advance: aircraft unavailability arising from it is not an unforeseeable external event, and neither is rebuilding a schedule after a disruption has passed.

Rejection letters rarely separate these causes. Establishing which one actually delayed your flight is often what decides the claim.

If Emirates rejects your claim citing extraordinary circumstances, FlyPayout verifies the defence against the actual flight data.

Emirates baggage compensation

Baggage sits under the Montreal Convention, to which the UAE and every EU member state are parties. If Emirates loses, delays or damages your checked luggage, you can claim up to 1,519 SDR — roughly €1,800 per passenger. That limit rose from 1,288 SDR on 28 December 2024 and covers destroyed, lost, damaged and delayed bags as one cap.

Unlike EC 261, the Montreal Convention applies in both directions, so your baggage rights survive on the return from Dubai even where your delay compensation rights do not. It is a limit rather than a fixed sum, so keep receipts for anything you had to replace.

Deadlines: report damage in writing within 7 days of receiving the bag, and delay within 21 days of delivery. Baggage still missing after 21 days is treated as lost.

See our guides to lost luggage, delayed luggage, and damaged luggage.

Time limits for filing an Emirates compensation claim

Because only Europe-departing flights fall under EC 261, the limitation period is set by the European country you left rather than by the UAE.

This varies widely. The United Kingdom allows 6 years, Spain and France 5, Germany and Austria 3, the Netherlands and Italy 2. Since Emirates operates more UK routes than almost any other non-European carrier, a large share of its claimable disruptions fall under the longest window in Europe.

If your flight left a European airport within the last few years, check rather than assume it has closed.

How FlyPayout Claims Your Emirates Compensation

Emirates, like most airlines, doesn't always pay compensation voluntarily. Claims may be ignored, delayed, or rejected with broad references to regional circumstances, and pursuing a carrier based outside Europe adds a layer most passengers cannot handle. FlyPayout handles the entire Emirates compensation claim process for you.

Step 1: Check your flight. Enter your Emirates flight details into our free compensation calculator. In under 2 minutes, you'll know if you're eligible for compensation and how much you could receive.

Step 2: Submit your claim. If your Emirates flight qualifies, FlyPayout handles everything — the paperwork, the airline communication, and the case management.

Step 3: Get paid. We negotiate with Emirates on your behalf. If they refuse to pay, our legal team takes the case to court. We only charge our fee when you receive your money.

Why Choose FlyPayout?

•      Downgraded from First or Business? We claim the 75% ticket reimbursement most passengers never hear about.

•      We separate a genuine airspace closure from a fleet retrofit programme, so the second is not written off as the first.

Frequently Asked Questions About Emirates Compensation

How much Emirates flight delay compensation am I entitled to?

€600 per passenger on almost every route, since nearly all Emirates services from Europe exceed 3,500 km. The exceptions are the eastern Mediterranean routes from Larnaca and Athens, which fall in the €400 band. Your fare and cabin make no difference to the figure.

My Emirates flight from Dubai to Europe was delayed. Can I claim?

Not under EC 261, since Emirates is a non-European carrier and the flight did not depart Europe. This boundary is stricter on Emirates than on alliance carriers, because its codeshare partner flydubai is also UAE-registered rather than European. Baggage rights under the Montreal Convention apply in both directions regardless.

I was moved from First to Business when the aircraft changed. What can I claim?

Reimbursement of 75% of the ticket price for that flight, under Article 10 of EC 261, since Europe to Dubai exceeds 3,500 km. This is separate from delay compensation and is owed regardless of why the aircraft was substituted. On premium fares it is frequently worth several times more than the €600.

My flight was sold by Emirates but operated by flydubai. Who pays?

flydubai, as the operating carrier. The two run a joint network with hundreds of daily codeshare flights, and a claim filed against the wrong entity is rejected without assessment. Your rights and the amount owed are identical either way.

Emirates blamed regional airspace disruption. Does that end my claim?

Not automatically. A specific closure that prevented your flight is an extraordinary circumstance. A delay caused by aircraft unavailability during the airline's own A380 reconfiguration programme, or by rebuilding a schedule after a disruption has passed, is not. Which one applies depends on the facts of your flight.

Is an Emirates refund the same as compensation?

No. A refund returns money you paid for a ticket you did not use. Compensation is a separate payment for the disruption itself. If Emirates cancelled your Europe-departing flight, you may be entitled to both, and accepting a refund does not waive the compensation claim.

I missed my connection to Sydney because the flight from London was late. What can I claim?

Compensation based on the total journey distance to Sydney, provided everything was on a single booking. The Dubai stop does not reset the calculation, and the relevant delay is measured on arrival at your final destination rather than at Dubai.

Your Emirates flight was disrupted. Get what you're owed.

Almost every Emirates route out of Europe is in the €600 band, and if you were downgraded the ticket reimbursement can be worth considerably more. If your flight left a European airport and was delayed three hours or more, cancelled at short notice, or you were denied boarding, that money is owed to you. Most passengers flying carriers based outside Europe assume they have no rights. On the departing leg, they do.

Check your Emirates flight now — it takes less than 2 minutes, and it's completely free.

FlyPayout helps passengers claim compensation for flight delays, cancellations, denied boarding, overbooking, missed connections, and baggage claims. Our service is risk-free — you only pay when we succeed.
