Air Montenegro is the flag carrier of Montenegro, operating from hubs at Podgorica Airport and Tivat Airport. Launched in June 2021 as the successor to the liquidated Montenegro Airlines, the airline connects Montenegro to destinations across Europe using a fleet of Embraer E195 aircraft. As of early 2026, it serves around 15 destinations in 10 countries, with routes to Belgrade, Zurich, Frankfurt, Istanbul, Prague, and seasonal destinations across the Mediterranean.
If your Air Montenegro flight was delayed, cancelled, or you were denied boarding, you have the same rights as passengers on any major European carrier. Air Montenegro is registered in Montenegro, an ECAA signatory, giving it the status of a European carrier under EC 261/2004. This means Air Montenegro flight compensation applies in both directions — departures from Europe and arrivals into Europe.
This guide explains your Air Montenegro passenger rights, how much you can claim, the Air Montenegro claim refund process, and how FlyPayout handles the entire case for you.
Air Montenegro is registered in Montenegro, which adopted EU Regulation EC 261/2004 into national law through the ECAA Agreement. This gives Air Montenegro the same legal status as Lufthansa, Air France, or any EU-registered carrier.
All Air Montenegro flights departing from any European airport are covered by EC 261, regardless of destination. A flight from Podgorica to Istanbul, from Tivat to Zurich, or from Belgrade to Podgorica are all covered.
All Air Montenegro flights arriving in Europe from outside are also covered, because Air Montenegro is a European carrier. This is a significant advantage over non-European carriers, where only departures from European airports are covered.
Standard EC 261 amounts apply:
| Flight distance | Compensation |
|---|---|
| Up to 1,500 km | €250 |
| 1,500 km to 3,500 km | €400 |
| Over 3,500 km | €600 |
Here are examples on common Air Montenegro routes:
| Route | Approximate distance | Compensation |
|---|---|---|
| Podgorica to Belgrade | ~350 km | €250 |
| Podgorica to Zurich | ~1,150 km | €250 |
| Podgorica to Frankfurt | ~1,350 km | €250 |
| Podgorica to Istanbul | ~1,200 km | €250 |
| Podgorica to Prague | ~1,200 km | €250 |
| Tivat to Belgrade | ~400 km | €250 |
| Tivat to Zurich | ~1,100 km | €250 |
| Podgorica to Paris | ~1,600 km | €400 |
| Podgorica to London | ~1,900 km | €400 |
These amounts are per passenger. A family of four on a qualifying Podgorica to London flight can claim €1,600 in total.
If your Air Montenegro flight arrives at its final destination 3 or more hours late, you are entitled to compensation. The delay is measured at arrival, not departure. In case of a delay caused by technical or operational reasons within the airline's control, the right to compensation applies in full.
Air Montenegro operates a small fleet of three Embraer E195 aircraft. With limited backup capacity, a single technical issue can cascade across the day's schedule — making delays more likely than at larger airlines with fleet reserves.

If Air Montenegro cancels your flight and notifies you less than 14 days before the departure date, you are entitled to Air Montenegro cancelled flight compensation at the same amounts as for delays. You also have the right to choose between a full refund and rebooking on an alternative flight.
With a small fleet and seasonal route fluctuations, Air Montenegro occasionally adjusts schedules mid-season. According to EC 261, if a schedule change is significant enough to be classified as a cancellation, compensation conditions apply.

If Air Montenegro involuntarily denies you boarding due to overbooking, compensation must be paid immediately at the airport. The airline must first seek volunteers before involuntarily bumping any passenger from the flight.

When Air Montenegro cancels a flight or delays it by 5 or more hours, your rights under EC 261 give you a choice. You can request a full refund of the ticket within 7 days, including all taxes and fees. Alternatively, you can choose rebooking on the next available flight to your destination, which may include flights on other airlines, or rebooking at a later date of your choosing subject to availability.
These rights apply regardless of the fare type or ticket conditions. Even if you purchased a non-refundable ticket, a cancellation by the airline entitles you to a full Air Montenegro claim refund. The airline cannot force you to accept a voucher or credit instead of a cash refund.
Regardless of the cause, Air Montenegro must provide care when the flight is delayed:
| Delay threshold | What you're entitled to |
|---|---|
| 2+ hours (flights up to 1,500 km) | Meals, refreshments, 2 phone calls or emails |
| 3+ hours (flights 1,500 km to 3,500 km) | Meals, refreshments, 2 phone calls or emails |
| 4+ hours (flights over 3,500 km) | Meals, refreshments, 2 phone calls or emails |
| Overnight delay | Hotel accommodation plus transport to and from the hotel |
| 5+ hours | Right to abandon the journey plus full refund |
If the airline does not provide care at the airport, cover costs yourself, keep all receipts, and claim reimbursement afterward.
Air Montenegro is exempt from paying compensation in case of extraordinary circumstances — events genuinely beyond its control. These include severe weather such as storms, fog, and snow (Podgorica and Tivat airports can be affected by strong bora winds), air traffic control restrictions or controller strikes, security threats, and airport closures by authorities.
The following are not extraordinary circumstances: technical faults (aircraft maintenance is the airline's responsibility — with a small fleet, technical issues have a disproportionate impact, but this does not exempt the airline from compensation), crew shortages or illness (staffing is within the airline's operational control), and airline staff strikes (courts have ruled these are not extraordinary circumstances).
If Air Montenegro rejects your claim citing extraordinary circumstances, FlyPayout independently verifies whether the defence is valid using flight data.
Air Montenegro is also liable for baggage issues under the Montreal Convention. If your checked luggage is lost, delayed, or damaged on an Air Montenegro flight, you can file an Air Montenegro baggage claim for up to 1,519 SDR (approximately €1,800) per passenger.
Key deadlines to keep in mind: a damaged baggage written complaint must be filed within 7 days of receiving the bag. For delayed baggage, the written complaint must be submitted within 21 days of receiving the bag. For lost baggage not returned after 21 days, file a full claim for the bag's value and its contents.
See our guides to lost luggage, delayed luggage, and damaged luggage.
In Montenegro, the statute of limitations for flight compensation claims is 2 years from the date of the disrupted flight. This applies to both EC 261 claims and Montreal Convention baggage claims. Within this period, a claim can be filed at any time — but filing sooner preserves evidence and speeds up resolution.
If you had a disrupted Air Montenegro flight any time after mid-2024, you can still file a claim. Don't wait.
Air Montenegro is a small carrier, and its claims-handling resources can be limited. Passengers may experience slow responses, vague rejections, or difficulty reaching the right department. FlyPayout handles the entire process for you.
You can contact Air Montenegro directly through their customer service, or let FlyPayout handle the process. Under EC 261, the airline must respond to your claim. If they don't, you can escalate to Montenegro's Civil Aviation Agency or pursue legal action.
If your Air Montenegro flight arrives 3 or more hours late at the final destination, you are entitled to compensation of €250 to €400 depending on distance — most Air Montenegro routes fall within the 1,500 km band at €250 — plus meals, refreshments, and hotel accommodation if needed. These rights apply because Montenegro is an ECAA signatory.
Yes. In case of a seasonal route being cancelled with less than 14 days' notice, standard EC 261 compensation applies. If Air Montenegro discontinues a route and notifies you 14 or more days in advance, no compensation is owed, but you retain the right to a full refund.
Under EC 261, Air Montenegro must offer a choice between a full refund within 7 days and rebooking. This applies regardless of ticket type and ticket conditions. Even non-refundable fares qualify for a refund when the airline cancels the flight.
Yes. EC 261 covers all Air Montenegro flights from both Podgorica and Tivat airports. The compensation amounts are the same regardless of which airport you departed from.
Yes. Under the Montreal Convention, Air Montenegro is liable for lost, delayed, or damaged checked baggage up to 1,519 SDR (approximately €1,800) per passenger. File a Property Irregularity Report at the airport check-in or baggage desk immediately, then submit a written claim within the applicable deadline.
No. Montenegro Airlines ceased operations in December 2020 and was subsequently liquidated. Air Montenegro is a separate company established by the Montenegrin government in 2021 as the country's new flag carrier. Claims against the former Montenegro Airlines cannot be pursued through the defunct carrier.
Air Montenegro is a European carrier with full EC 261 obligations. If your flight from Podgorica or Tivat was delayed, cancelled, or overbooked, you may be entitled to up to €600 per person. Most passengers never claim. Don't be one of them.
